Brad Rothman is a Southwest Florida attorney Board Certified in Labor and Employment Law by The Florida Bar. Certification is the highest level of recognition given by The Florida Bar for competency and experience within an area of law.

As a recognized expert in employment law, Mr. Rothman specializes in providing representation in employment related litigation and administrative proceedings. Additionally, Mr. Rothman represents whistleblowers in qui tam cases, represents policy holders in insurance disputes, and maintains a general civil litigation practice.

In the area of employment law, Mr. Rothman provides individual and class representation for litigation involving overtime (FLSA), discrimination, retaliation, sexual harassment, whistleblowers, non-compete agreements, FMLA, USERRA, unpaid wages, commissions, wrongful termination, hostile work environment, and employment contracts. Mr. Rothman also provides representation for unemployment appeals and PERC appeals, and provides advice in connection with employment agreements, severance agreements, and non-compete agreements..

With extensive experience representing plaintiffs (relators) in False Claims Act (qui tam) cases, Mr. Rothman also focuses his practice on providing representation for whistleblowers in matters concerning healthcare fraud, Medicare fraud, Medicaid fraud, and Tricare fraud. Mr. Rothman helps whistleblowers claim rewards, maximize rewards, and protect employment.

Mr. Rothman also represents policy holders in insurance disputes. To this end, Mr. Rothman handles cases involving hurricane damage, wind, flood, homeowners insurance, business owners insurance, property damage, commercial property, life insurance, disability insurance, insurer bad faith, and most other matters involving litigation against an insurance company.

In addition to employment, whistleblower, and insurance matters, Mr. Rothman provides representation for a broad range of civil matters, including cases involving sexual abuse and sexual battery, business disputes, partnership disputes, trade secrets, deceptive and unfair trade practices, collections, and defamation of character.

Mr. Rothman has an AV rating from Martindale-Hubbell, the highest attorney rating awarded by that service. From 2009 to 2014, Mr. Rothman was named a Rising Star by Florida Super Lawyers Magazine.

Mr. Rothman received his law degree with honors from University of Florida, where he served as Senior Research Editor of the Florida Law Review, and received the Law Review’s Frank E. Maloney Award (outstanding candidate) and Outstanding Associate Editor Award. While in law school, Mr. Rothman authored 401(k) Plans in the Wake of the Enron Debacle, 54 Fla. L. Rev. 921 (2002). As an attorney, Mr. Rothman co-authored Just the Facts: A Call for Clarification and Simplification of the Eleventh Circuit’s Standard of Review for an ERISA Claims Fiduciary’s Factual Determinations, 5-1 Mealey’s Litig. Report: Disability Ins. 13 (2004).

Before law school, Mr. Rothman earned a master’s degree from Columbia University, before working for the Federal Aviation Administration as an analyst. Mr. Rothman earned his bachelor’s degree from Quinnipiac University, graduating magna cum laude.

Mr. Rothman serves on the board of directors of the Southwest Florida Federal Court Bar Association, having previously served on the executive committee. Mr. Rothman also serves on the Labor & Employment Board Certification Committee for the Florida Bar. In addition, Mr. Rothman is a member of the Collier County Bar Association, the Michael R N McDonnell American Inn of Court, the Labor and Employment Law Section of The Florida Bar, and the Florida Chapter of the National Employment Lawyers Association.

Mr. Rothman is licensed to practice in all of Florida’s state courts, the United States District Court for the Middle District of Florida, the United States District Court for the Southern District of Florida, and the United States Court of Appeals for the Eleventh Circuit.
