Bradley P. Rothman (Member)
Bradley Rothman is a Southwest Florida attorney Board Certified in Labor and Employment Law by The Florida Bar. Certification is the highest level of recognition given by The Florida Bar for competency and experience within an area of law. Mr. Rothman focusses his practice on employment law, insurance disputes, and whistleblower (qui tam) litigation.
In the area of employment law, Mr. Rothman is a recognized expert, providing representation and advice to employees in a wide range of matters, such as claims involving overtime (FLSA), commissions, and unpaid wages; FMLA leave, pregnancy, and disabilities; non-compete agreements and employment contracts; employment benefits (ERISA); sexual harassment and sexual misconduct; discrimination and retaliation; and hostile work environment and wrongful termination.
In the area of insurance, Brad provides representation to policy holders in claims involving matters such as hurricane damage, wind damage, water damage, fire damage, property damage, roof damage, commercial property, homeowners insurance, life insurance, disability insurance, insurer bad faith, and most other matters involving litigation against an insurance company.
In addition, Attorney Rothman provides employees representation in False Claims Act (qui tam) cases, where he assists whistleblowers of healthcare fraud, Medicare fraud, Medicaid fraud, and Tricare fraud claim rewards, maximize rewards, and protect employment.
Mr. Rothman has an AV rating from Martindale-Hubbell, the highest attorney rating awarded by that service. He has been recognized as a Super Lawyer and as a Rising Star by Florida Super Lawyers, as Legal Elite by Florida Trend, and as a Top Lawyer in the areas of employment law and insurance law by Naples Illustrated.
Brad received his law degree with honors from University of Florida, where he served as Senior Research Editor of the Florida Law Review, and received the Law Review’s Frank E. Maloney Award (outstanding candidate) and Outstanding Associate Editor Award. While in law school, Brad authored 401(k) Plans in the Wake of the Enron Debacle, 54 Fla. L. Rev. 921 (2002). As an attorney, Mr. Rothman co-authored Just the Facts: A Call for Clarification and Simplification of the Eleventh Circuit’s Standard of Review for an ERISA Claims Fiduciary’s Factual Determinations, 5-1 Mealey’s Litig. Report: Disability Ins. 13 (2004).
Before law school, Mr. Rothman earned a master’s degree from Columbia University, before working for the Federal Aviation Administration as an analyst. Mr. Rothman earned his bachelor’s degree from Quinnipiac University, graduating magna cum laude.
Attorney Rothman serves on the Executive Board of the Southwest Florida Federal Court Bar Association. Mr. Rothman also serves on the Labor & Employment Board Certification Committee for the Florida Bar (Vice Chair 2023). In addition, Mr. Rothman is a member of the Collier County Bar Association, the Labor and Employment Law Section of The Florida Bar, and the Florida Chapter of the National Employment Lawyers Association.
Mr. Rothman is licensed to practice in all of Florida’s state courts, the United States District Court for the Middle District of Florida, the United States District Court for the Southern District of Florida, and the United States Court of Appeals for the Eleventh Circuit.
